Cendyn Law Enforcement Request Policy
- PURPOSE
This policy outlines the procedures for handling requests from law enforcement agencies for user data, customer data, records, or other information. Our goal is to balance compliance with legal obligations while protecting the privacy and rights of our customers and their customers (“users”). - SCOPE
This policy applies to all employees, contractors, and affiliates of Cendyn. It covers requests from local, state, federal, and international law enforcement agencies. - GENERAL PRINCIPLES
- User Privacy: We prioritize user privacy and confidentiality. User data will only be disclosed in accordance with our Privacy Policy, applicable laws and this policy.
- Legal Compliance: We comply with valid legal requests issued under applicable laws and/or issued from law enforcement or governmental agencies. Valid requests include subpoenas, court orders, and search warrants.
- Transparency: If legally permissible, we will notify users of any requests for their data before disclosure.
- HOW WE RESPOND TO DIFFERENT TYPES OF REQUESTS
- Subpoenas: A subpoena may require us to provide certain user information. We will review the subpoena for legal validity before responding and only produce information within the scope of the subpoena’s request.
- Court Orders: A court order may compel us to disclose information. We will ensure the order is properly signed and issued by a competent court of applicable jurisdiction.
- Search Warrants: A search warrant allows law enforcement to obtain user data directly. We will verify the warrant’s validity and scope before complying.
- Emergency Requests: In cases of imminent danger, such as threats to life or safety, we may expedite the release of information without legal process but will document the request and our response.
- PROCEDURE FOR HANDLING REQUESTS
- Verification: All requests must be in writing and come from a verified source with valid and applicable legal authority. Requests should include details about the specific information sought, and the legal basis for the request.
- Legal Review: Our Legal Department reviews all requests to ensure they are valid, specific, and comply with applicable laws.
- User Notification: Unless prohibited by law, we will notify the affected user(s) of the request before disclosing their data. This gives them an opportunity to challenge the request if they wish.
- Data Minimization: We will disclose only the specific data requested, ensuring that no more information than necessary is provided.
- Record Keeping: All requests and our responses will be documented and retained securely for future reference.
- REFUSAL OF REQUESTS
- Invalid Requests: We reserve the right to refuse any request that is overly broad, lacks proper legal authority, or does not comply with our policies.
- Challenging Requests: If a request is unclear, overly broad, or appears to violate user rights, we may seek clarification or challenge the request in court.
- EMERGENCY DISCLOSURE
In situations involving immediate danger to life or serious physical injury, we may disclose information without legal process. Such disclosures will be carefully documented and subject to review. - INTERNATIONAL REQUESTS
Requests from foreign law enforcement agencies will be treated with the same scrutiny as domestic requests. International requests must comply with applicable laws and international treaties. - CONTACT INFORMATION
